1. Introduction and Acceptance

Welcome to ifeedback.app (the "Platform"). This Platform is owned and operated by iFeedback Consulting (Pty) LTD ("iFeedback," "we," "us," "our"), a company registered in South Africa.

These Terms and Conditions ("Terms") govern your access to and use of the Platform, including participation in the iFeedback Citizen Scientist community, interaction with polls (such as 'Green Insights'), and use of any related content or features offered on the Platform.

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Platform.

2. Definitions

  • Platform: Refers to the website ifeedback.app and its associated services and features.
  • User / You: Refers to any individual accessing or using the Platform, including members of the Citizen Scientist community.
  • Citizen Scientist Community: Refers to the opt-in database and program hosted on the Platform for individuals participating in research surveys and polls.
  • Content: Refers to all text, graphics, images, data, software, and other material available on the Platform.
  • Services: Refers generally to the functionalities offered via the Platform (community participation, polls) and the underlying technology supporting research deployment managed by iFeedback. (Note: Specific research services provided to clients are governed by separate agreements via ifeedback.co.za).

3. Use of the Platform

  • Permitted Use: You may use the Platform for its intended purposes: learning about our platform, joining and participating in the Citizen Scientist community and associated polls/surveys, and accessing published insights where available.
  • Prohibited Conduct: You agree not to use the Platform to:
    • Engage in any unlawful activity or violate any applicable laws (including POPIA, CPA, ECT Act).
    • Provide false or misleading information during registration or participation.
    • Attempt to interfere with the Platform's security or functionality (e.g., inject malicious code, conduct denial-of-service attacks).
    • Scrape, harvest, or collect information about other users without consent.
    • Impersonate any person or entity.
    • Transmit spam or unsolicited communications.

4. User Accounts and Registration

  • To participate fully in the Citizen Scientist community and potentially other features, registration may be required.
  • You agree to provide accurate and complete information during registration and keep it updated.
  • You are responsible for maintaining the confidentiality of your account login information (if applicable) and for all activities that occur under your account.  
  • Notify us immediately of any unauthorized use of your account.  

5. Citizen Scientist Community Participation

  • Participation is voluntary.
  • You agree to provide honest and thoughtful responses to surveys and polls to the best of your ability.
  • Your participation and the handling of your personal information and responses are governed by our Privacy Policy, which details anonymity procedures, data usage, and your rights under POPIA.
  • Unless explicitly stated otherwise in a specific survey invitation and consent form (subject to University Ethics Clearance), individual responses are treated as anonymous for research reporting.
  • Compensation or rewards for participation are not guaranteed and will be clearly specified in individual survey/poll invitations if applicable (See FAQ on Contact page for more details).

6. Intellectual Property

  • Our Content: The Platform and its original content (excluding user-provided data), features, and functionality are and will remain the exclusive property of iFeedback Consulting (Pty) LTD and its licensors, protected by copyright and other intellectual property laws. Our logos and brand names are our trademarks.
  • Published Insights: Aggregated and anonymized data or insights published by us on the Platform or related sites (e.g., ConservationMag.org) are our intellectual property.
  • User Data: Ownership and use of data provided by you (personal information, survey responses) are governed by our Privacy Policy and specific consent agreements.

7. Disclaimers

  • The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
  • We do not guarantee that the Platform will be uninterrupted, secure, or error-free.  
  • We do not warrant the accuracy, completeness, or reliability of any content available on or through the Platform (especially content linked to third-party sites).
  • We disclaim liability for any content or conduct of third-party surveys facilitated through the platform, although we require ethical clearance for academic studies. Participant discretion is advised.

8. Limitation of Liability

To the fullest extent permitted by applicable South African law, iFeedback Consulting (Pty) LTD, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, delict (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.  

9. Indemnification

You agree to defend, indemnify, and hold harmless iFeedback Consulting (Pty) LTD and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Platform, or b) a breach of these Terms.  

10. Third-Party Links

The Platform may contain links to third-party websites or services that are not owned or controlled by iFeedback. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that iFeedback shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.  

11. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Platform will immediately cease.  

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.  

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through amicable negotiation. If negotiation fails, the dispute shall be subject to mediation in Cape Town or the jurisdiction of the courts of Cape Town, South Africa.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice (e.g., by posting on the Platform or via email) prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms.
